Biographical / Historical

This case is a review of a ruling of Georgia courts that union-shop contracts are invalid since under them the dues of unwilling members may be used for political purposes disagreeable to the members.
The Georgia decision involves union-shop contracts in the Southern Railway System. On the plea of a half-dozen employees, who were included among those who had to join unions in 1953 when the Southern System's union-shop contracts went into effect, the Georgia Supreme Court found that the argeements violated the First and Fifth Amendments to the Constitution of the United States, being particularly vulnerable to the charge that dues collected from unwilling members are used to support ideological and political doctrines and candidates which plaintiffs, intervening plaintiffs and other class represented by them, are and will be opposed to and not willing to support voluntarily.

This collection consists of court documents related to the case brought by the International Association of Machinists, et al. against S.B. Street el al., which concerned the use of union shop dues for political purposes. The case was argued before the Supreme Court of the United States.
