Abstract:
This memorandum attempts to explore in as close chronological order as possible the appellate phase of the litigation in an effort to gather in one integrated document the language of the appellate courts. Mr. Bergan's purpose was to dispel the charge of "litigious obstruction" which he believed was irresponsible.

Wright was chief of the Massachusetts Bureau of Statistics of Labor, 1873-1888; President of the National Convention of Chiefs and Commissioners of Bureaus of Statistics of Labor, 1883-1903; and the first U.S. Commissioner of Labor, 1885-1905.
